Do you want to come to Australia to live with your Australian partner? Or are you already in Australia living with your partner and you wish to remain in Australia permanently?
Many partner visa clients are unaware of the comprehensive detail of evidence that is required to support a partner visa application. Not supplying all of the required documents can lead to a very lengthy visa process, stress and possibly a visa refusal.
Some clients are also unaware that the definition of ‘partner’ for Immigration Law purposes may be different to their definition of ‘partner’. What does 'defacto' exactly mean for immigration law purposes?
An Australian citizen or permanent resident may be able to sponsor their non-citizen partner for a temporary or permanent visa.A non-citizen partner can be either the spouse or de-facto of the Australian sponsor.
Spouse is a married partner, while de-facto is a non-married partner, and both spouse and de-facto can include same-sex partners. The definition of what a defacto partner is for immigration law purposes is detailed and is prescribed in the regulations. Contact us if you would like it explained.
The main partner visas are:
- Prospective Marriage visa (subclass 300)
- Offshore Partner (subclasses 309 and 100)
- Partner visa (subclasses 820 and 801)
For the subclass 300 visa, partners will have to provide evidence that they intend to marry.
The '4 pillars'
For the Offshore subclasses 309/100 and the Onshore subclasses 820/801 partner visas, partners will have to provide evidence that they meet the ‘4 pillar' criteria which include:
- The social aspects of the relationship
- The joint financial aspects of the relationship
- The nature of the household
- The nature of commitment & development of the relationship
